The #ElectoralOffencesCommissionBill, 2018 (SB. 469) was sponsored by Senator Abubakar Kyari of Borno North Senatorial District.

The #ElectoralOffencesCommissionBill went for first reading on the 11th of April, 2017 and second reading on the 11th of October, 2017.

The Bill is for an Act that is intended to establish a body known as the National Electoral Offences (NEOC) which is aimed at addressing issues that are related to electoral offences as well as the adoption of measures to prevent and eradicate the same.

Functions of the Commission:
The functions of the Commission include:
I. The enforcement and due administration of the provisions of the Bill.

II. The investigation of all electoral offences, electoral corruption and violations of electoral due process in any election.

III. The adoption of measures including preventative and regulatory actions, the introduction and maintenance of investigative and control techniques to prevent electoral offences.

IV. Taking charge of supervising, controlling, coordinating all responsibilities, functions and activities relating to investigations and prosecution of all offences connected with or relating to investigations with or relating to elections conducted under the 2010 electoral (as amended).

V. Liaising with the Attorney-General of the Federation, the Independent National Electoral Commission (INEC), all government security and law enforcement agencies and such other supervisory institutions involved in the eradication of electoral offences.

VI. Carrying out and sustaining rigorous public and enlightenment campaign against electoral offences, electoral corruption and electoral due process.

Powers of the Commission.
The Commission has powers to:
I. Investigate a person, corporate body or organization.

II. Arrest and procure arrest.

III. Initiate, develop or improve specific training programmes for its law enforcement personnel.

IV. Establish special units for the effective conduct of its functions.

The Commission shall submit a report of its activities during the immediately preceding year, which shall include the audited accounts of the Commission no later than the 30th day of September in each year.

This gives an officer of the Commission who is investigating or prosecuting an offence under this #ElectoralOffencesCommissionBill, all the powers and immunities of a police officer under the Police Act.

The #ElectoralOffencesCommissionBill, 2017 (SB. 469) was referred to the Committee on INEC and Judiciary.
